By subscribing the parties agree as follows:

1 Services provided

A. Echosploit will:

1.1 Provide continuous security via threat (danger) detection

1.2 Periodic security reports based on the selected tier (Basic/Pro/Premium)

1.3 Add more depending on the subscription plan

B. Services Explanation

Below is an overview of the key services we provide to ensure you are always informed and protected against potential threats.

1.4 Security Alerts & AI Advisory

EchoSploit continuously monitors your systems for any signs of trouble (refer also to the item 4.1). We focus on delivering critical security alerts directly to you. These alerts are only deliver when significant threats are detected, ensuring you are notified of urgent issues without being overwhelmed by non-critical updates.

Based on the selected plan level Echosploit assist with an add-on such as AI assistance upon critical alerts, with basic advisory for action, which should be undertaken and managed by Client. This add-on depend on the selected plan.

Client is responsible for taking specific actions to mitigate any issues, using their own resources.

1.5 Monthly Security Events Report

Each month, you will be provided with a comprehensive security events report from EchoSploit. This report provides a detailed summary of the total number of alerts we have analysed to identify potential threats.

1.6 Monthly or Quarterly Vulnerability Report

Our vulnerability report, provided either monthly or quarterly depending on your subscription plan, lists all vulnerabilities detected on the devices we are monitoring. This report is crucial as it highlights weaknesses in your systems that could be exploited if not addressed.

We recommend paying close attention to these reports and prioritizing the resolution of any listed vulnerabilities to maintain a strong security posture. Resolving these issues promptly is vital to prevent potential breaches.

1.7 Threat Intelligence

In addition to alerts and reports, EchoSploit provides a threat intelligence report that is delivered on a weekly, bi-weekly, or monthly basis (depending on your subscription plan) and contains valuable information about the latest threats and trends in cybersecurity. While this report is primarily for informational purposes, it helps you stay informed about the broader security environment and how emerging threats could impact your business.

2 Confidentiality

Echosploit keeps all work product and shared information strictly private and confidential and will not disclose it to any third parties.

3 Term and Termination

3.1 This agreement starts upon making the payment and automatically renews every month. The minimum contract term is as follows based on your plan:

• If you are on the Basic Plan, your minimum contract term is 3 months, after which it transitions to a monthly rolling contract, unless you have opted for the annual payment option, in which case the term is per year.

• If you are on the Pro Plan, your minimum contract term is 2 months, after which it transitions to a monthly rolling contract, unless you have opted for the annual payment option, in which case the term is per year.

• If you are on the Premium Plan, your contract is monthly rolling from the start, unless you have opted for the annual payment option, in which case the term is per year.

Either party may terminate this agreement with 30 days written notice.

3.2 Either party may terminate the agreement if the other party has breached a covenant, obligation, or warranty under this Agreement, and such breach remains uncured for a period of thirty (30) days after notice thereof is sent to the other party.

3.3 In the event that EchoSploit’s systems experience failure and your protection is compromised, you may terminate the contract immediately. You are entitled to reimbursement for the current month if our systems are down for more than 1% of the time during any given month, as our guarantee is 99% uptime.

4 Limitation of Liability

4.1 Cybersecurity Specific Disclaimer

The Company provides cybersecurity services to alert on detected vulnerabilities and threats. Due to the limited access and understanding of the Client's infrastructure and systems, the Company cannot take liability if the Client experiences a breach or hacking incident. The Echosploit does not have full control over the systems and, therefore, does not take responsibility for any such incidents.

4.2 Neither party is liable for indirect damages. Total liability is limited to the fees paid in the 12 months preceding the claim.

In the event either party terminates this Agreement pursuant to this Paragraph, all payment is final, and no refund will be granted.

5 Cybersecurity Specific Disclaimer 

While EchoSploit is committed to providing robust cyber security measures and diligent threat monitoring (using known, trusted and widely recognized tools), it is important to note that no system can offer absolute protection against all potential threats. The rapidly evolving nature of cyber threats means that 100% security is unattainable. However, EchoSploit will work tirelessly to minimize risks and respond swiftly to any vulnerabilities and risks detected, ensuring your systems remain as secure as possible. 

6 Dispute Resolution 

Any disputes should be resolved as soon as possible directly between parties. If this is not possible dispute will be resolved as the last resort in a court of law, under jurisdiction in the United Kingdom, with proceedings conducted by any man or woman acting in a judicial or similar capacity. 

7 Modification Right

We reserve the right to modify these Terms of Use at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms of Use. We encourage you to review these terms periodically. Additionally, you will be individually informed of any significant or major changes to the Terms of Use.
